1. Acceptance of Terms

By accessing and using Mijengo ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Mijengo is an online platform that connects property owners, real estate agents, and potential buyers or renters in Tanzania. We provide a marketplace for listing, searching, and facilitating real estate transactions.

2.1 Services Include:

  • Property listing and search functionality
  • Communication tools between users
  • Transaction facilitation services
  • Property verification and validation
  • Payment processing services

3. User Accounts

3.1 Account Creation

To use certain features of our service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for maintaining the confidentiality of your account. You agree not to disclose your password to any third party and to take sole responsibility for activities that occur under your account.

3.3 Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these terms or for any other reason we deem appropriate.

4. Property Listings

4.1 Listing Requirements

All property listings must be accurate, complete, and not misleading. You must have the legal right to list the property and must provide all required documentation upon request.

4.2 Prohibited Listings

The following types of listings are prohibited:

  • Properties you do not own or have authorization to list
  • Properties with disputed ownership
  • Properties that violate local zoning laws
  • Listings with false or misleading information
  • Properties used for illegal activities

4.3 Listing Approval

All listings are subject to our approval process. We reserve the right to reject, remove, or modify any listing that violates these terms or our community standards.

5. Fees and Payments

5.1 Commission Structure

Mijengo charges a 3% commission on successful transactions. This fee is only charged when a property is successfully rented or sold through our platform.

5.2 Payment Processing

All payments are processed through secure, third-party payment processors. We do not store your payment information on our servers.

5.3 Refund Policy

Refunds are processed according to our refund policy. Commission fees may be refunded if a transaction is cancelled due to issues on our platform.

6. User Conduct

6.1 Acceptable Use

You agree to use the platform only for lawful purposes and in accordance with these terms. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit any harmful or malicious code
  • Attempt to gain unauthorized access to our systems
  • Use the platform for fraudulent activities
  • Harass, abuse, or harm other users

6.2 Content Standards

All content you post must be appropriate, accurate, and not violate any third-party rights. We reserve the right to remove any content that violates these standards.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our service, you agree to the collection and use of information in accordance with our Privacy Policy.

8. Intellectual Property

8.1 Platform Content

The platform and its original content, features, and functionality are owned by Mijengo and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 User Content

You retain ownership of content you post, but grant us a license to use, display, and distribute your content on the platform.

9. Disclaimers and Limitations

9.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The platform may be unavailable due to maintenance, updates, or technical issues.

9.2 Property Information

While we verify listings, we do not guarantee the accuracy of all property information. Users should conduct their own due diligence before making any transactions.

9.3 Limitation of Liability

To the maximum extent permitted by law, Mijengo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

10. Indemnification

You agree to indemnify and hold harmless Mijengo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform or violation of these terms.

11. Dispute Resolution

11.1 Mediation

We encourage users to resolve disputes through our internal mediation process before pursuing legal action.

11.2 Governing Law

These terms are governed by the laws of Tanzania. Any disputes will be resolved in the courts of Tanzania.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or platform notifications. Continued use of the platform after changes constitutes acceptance of the new terms.
